PLEASE READ THIS DOCUMENT CAREFULLY BEFORE PLACING AN ORDER.

By placing an order with us, you ("the Customer", "you", "your") confirm that you have read, understood, and automatically agree to be legally bound by these Terms and Conditions, including our Return Policy and Data Protection rules, in their entirety. If you do not agree to these terms, please do not place an order.

1. Eligibility & Your Status

By placing an order through our site, you warrant that:

• You are legally capable of entering into binding contracts, and are at least 18 years old.

• You are purchasing our products as a consumer and for domestic, private use only (not for resale or commercial purposes).

2. The Contract Between Us

• Order Acknowledgement: After placing an order, you will receive an email acknowledging we have received it. This does not mean your order has been accepted.

• Order Acceptance: A legally binding contract is only formed when we dispatch your items and send you a Shipping Confirmation email.

• Cancellation by Us: We reserve the right to refuse or cancel any order before dispatch for reasons including, but not limited to: stock unavailability, pricing errors, or suspicion of fraudulent activity. If we cancel an order after payment, we will issue a full refund immediately.

3. Product Descriptions, Scent Variation, & Safety

• Handmade Variations: Our wax melts and fresheners are handmade. You acknowledge that minor variations in colour, design, botanical placement, and shape are a natural part of the product and do not constitute a fault.

• Scent Profiles: Scent description is subjective. We describe our fragrances as accurately as possible, but we cannot guarantee that a scent will match your personal expectations or taste.

• Product Safety & Usage:

  • All home fragrance products must be used in strict accordance with the safety instructions provided on our packaging, including CLP labels (Classification, Labelling and Packaging regulations).

  • Wax melters must be used on a heat-resistant surface, away from drafts, children, and pets. Never leave a burning flame or turned-on electric melter unattended.

  • We cannot be held liable for any damage, injury, or loss caused by the incorrect use, neglect, or unsafe handling of our products.

4. Pricing and Payment

• All prices are listed in GBP (£) and exclude delivery costs, which will be added at checkout.

• We reserve the right to update prices at any time, but changes will not affect orders that have already been accepted and dispatched.

• Payment must be made in full at the time of ordering via our approved checkout methods.

5. Delivery

• We will deliver the goods to the address provided by you during checkout. It is your responsibility to ensure these details are accurate. We cannot be held liable for delayed or lost deliveries due to incorrect address inputs.

• Delivery dates are estimates only. While we make every effort to dispatch orders within [e.g., 2-3 working days], we are not liable for delays caused by postal services or third-party couriers.

• If a package is returned to us because it was uncollected from a sorting office, you will be responsible for the cost of re-delivery.

6. Return & Refund Policy

As a UK business, our return policy fully complies with the Consumer Rights Act 2015 and the Consumer Contracts Regulations. Your rights to cancel, return goods, and receive a refund are governed entirely by our Return & Refund Policy, which is incorporated into these Terms and Conditions by reference. ​

7. Data Protection and UK GDPR

We take your privacy seriously and process all personal data in strict accordance with the UK GDPR and the Data Protection Act 2018.

• Data Collection: When you place an order, you provide us with personal information such as your name, billing address, delivery address, email address, and phone number.

• Lawful Basis for Processing: We process this data purely on the lawful basis of Performance of a Contract—meaning we only collect and use this information to fulfill your order, handle deliveries, process payments, and manage returns or queries.

• Third-Party Sharing: We will never sell your personal data. We only share your information with essential third-party service providers necessary to complete your order, specifically payment gateways (to process payments safely) and courier/postal services (to deliver your products).

• Marketing Communications: We will only send you marketing emails or promotional offers if you have given us your explicit, active consent by opting in via a checkbox at checkout. You can unsubscribe at any time.

• Data Retention: We keep your order information for as long as necessary to fulfill the order, handle customer service issues, and comply with UK tax law (which requires us to keep financial records for 6 years).

• Your Rights: You have the right to request access to the personal data we hold about you, request corrections, or ask us to delete your data (where legally permissible). For data queries, email contact@aaascentednest.co.uk.

8. Limitation of Liability

• If we fail to comply with these Terms, we are only responsible for loss or damage you suffer that is a predictable, foreseeable result of our breach.

• We are not liable for business losses. We only supply products for private, domestic use. If you use our products for any commercial, business, or re-sale purpose, we will have no liability to you for any loss of profit, business interruption, or business opportunity.

• Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law (including the Consumer Rights Act 2015).

9. Intellectual Property

All content on our website—including text, images, logos, product descriptions, and unique scent names—is the intellectual property of A&A Scented Nest and is protected by UK copyright laws. You may not copy or use any content without our express written permission.

10. Governing Law

These Terms and Conditions, and any dispute or claim arising out of them, shall be governed by and construed in accordance with the laws of England. Any legal proceedings will be handled exclusively in those courts.

11. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time to reflect changes in the law, marketplace conditions, or our business practices. The terms in effect at the time you place your order will be the terms that apply to that contract.
